Digital Content Terms

These Digital Content Terms govern DARKFIELD Radio digital audio experiences (including ETERNAL), supplied by Realscape Productions Pty Ltd (ABN 86 625 039 956), 90 Islington St, Collingwood VIC 3066 ("Realscape", "we", "us" or "our").
1. What these terms cover
These Digital Content Terms apply when you buy or access a DARKFIELD Radio digital audio experience, including ETERNAL. DARKFIELD Radio is our catalogue of digital audio experiences; ETERNAL is one experience within it. These Terms sit on top of our general Terms of Use and our Privacy Policy. Where these Digital Content Terms and the general Terms cover the same subject, these specific Terms control.
2. One-time purchase - no subscription, nothing auto-renews
A DARKFIELD Radio experience is a one-time purchase. You pay once for access to that experience. There is no subscription, no recurring charge and nothing auto-renews. You will not be billed again unless you make a new purchase.
3. How you get access
After purchase, access is delivered to the email address you provide, via a one-time access code (no account or password is created). Access is for one listen of the experience you bought. Please make sure your email address is correct at checkout.
4. Audience guidance and content
DARKFIELD Radio experiences are intended for mature and older-teen audiences and may include intense, unsettling or psychologically immersive content delivered through audio and darkness. The recommended minimum age and a content description for each experience are shown on its page before you buy - please check these before purchasing or listening, and ensure the experience is suitable for the intended listener.
5. Refunds - no refund once access is granted
Because a digital audio experience is delivered for immediate access and consumed on listening, once we have issued your access code, or the experience has otherwise been made available to you, the purchase is non-refundable for change of mind. This is shown clearly and you agree to it before you pay.
- Your consumer guarantees still apply. This no-refund term removes only a change-of-mind refund. It does not exclude your rights under the Australian Consumer Law: if a digital experience has a major failure (for example, it is not delivered, or does not work as it should), you are entitled to a remedy you choose - a refund or compensation for the drop in value - and that right cannot be excluded.
- Goodwill. We may, at our discretion, help where something has genuinely gone wrong (for example, a technical failure that prevented access). This is goodwill, separate from and additional to your consumer guarantees.
6. How you agree to these terms
You agree to these Digital Content Terms at checkout by ticking the "I agree" box before you pay. You cannot complete a digital purchase without doing so.
7. Licence and acceptable use
Your purchase gives you a personal, non-transferable, non-commercial licence to access and listen to the experience you bought, for the access granted (one listen). You may not copy, record, redistribute, publicly perform, or circumvent any access or playback controls. All content remains owned by us or our licensors (DARKFIELD is licensed intellectual property - see our Terms of Use).
8. Your consumer rights under the Australian Consumer Law
Nothing in these Terms excludes, restricts or modifies the consumer guarantees or any other right you have under the Australian Consumer Law that cannot lawfully be excluded. See section 5 for how this applies to refunds.
9. Governing law and disputes
These Terms are governed by the laws of the State of Victoria, Australia, and you and we submit to the courts of Victoria, except that this does not deprive you of the mandatory consumer protections of the Australian Consumer Law. There is no mandatory arbitration clause and no class-action waiver.
