Terms of Use

These Terms of Use ("Terms") govern your use of the websites and online services operated by Realscape Productions Pty Ltd (ABN 86 625 039 956), 90 Islington St, Collingwood VIC 3066 (the "Site" and "Services"), and your purchase of tickets to our live and immersive experiences. They are a contract between you and Realscape Productions Pty Ltd, which we refer to as "Realscape", "we", "us" or "our".
By accessing or using the Site, you agree to these Terms. If you do not agree, do not use the Site.
Part A - Using our site
1. About these terms and who we are
These Terms cover your general use of the Site and Services, and (in Part B) the tickets you buy from us. Realscape sells through more than one channel, and some purchases are also covered by more specific terms. Section 2 explains how they fit together.
2. How these terms fit with our other terms
Realscape sells through more than one channel. These general Terms are the base layer. More specific terms apply on top of them, and where a more specific term covers the same subject, the more specific term controls (and can never reduce a right you have under law that cannot be excluded):
- Ticketing. Buying a ticket to a live or immersive experience is governed by these Terms (see Part B) and by the event-specific terms shown to you at the point of purchase for that event.
- Digital products. Buying a digital audio experience (DARKFIELD Radio, including ETERNAL) is also governed by our Digital Content Terms, shown to you on the product page and at checkout.
- Privacy. Our handling of your personal information is described in our Privacy Policy.
- Your consumer rights. Mandatory Australian consumer protections apply to you regardless of these Terms (see section 18).
3. Eligibility and age
Access to the Site and to individual experiences may be subject to minimum-age and other eligibility requirements. Any such requirement - including the minimum age or content rating for a particular experience, and whether an adult must complete the purchase - is shown at the point of purchase for that ticket or digital experience. The minimum age to use the Site, and how we handle personal information, are set out in our Privacy Policy.
4. Your account and use of the Site
You agree to use the Site lawfully and not to: interfere with or disrupt the Site or its security; attempt to access areas or data you are not authorised to access; scrape, harvest or use automated means to collect data except as expressly permitted; circumvent any purchase limits or anti-bot measures; or use the Site to infringe anyone's rights. We may suspend or limit access where we reasonably believe these Terms have been breached, acting proportionately.
5. Intellectual property
The Site and its content - including text, graphics, logos, audio, video, designs, and the "DARKFIELD" and "Realscape" brands - are owned by us or our licensors and are protected by intellectual-property laws. DARKFIELD is licensed intellectual property; Realscape uses it under licence and does not claim to own it. You may use the Site for your own personal, non-commercial purposes only. You may not copy, reproduce, distribute, publicly perform, or create derivative works from any content without our prior written permission or that of the relevant rights holder.
6. Third party links and services
The Site may link to or rely on third party websites and services (for example, payment processing and mapping). We are not responsible for the content or practices of third parties. Your use of a third party's service is governed by that third party's terms. How third parties receive and handle your personal information is described in our Privacy Policy.
Part B - Buying tickets
7. What these ticketing terms cover
This Part applies when you buy a ticket to a Realscape live or immersive experience. It applies alongside the event-specific terms shown to you at the point of purchase. Where an event-specific term covers the same subject, the event-specific term controls - but it can never reduce the protections in these terms or any right you have under the Australian Consumer Law that cannot be excluded.
8. Pricing and fees
The price shown for a ticket at checkout is the total price you pay, inclusive of GST. It includes any applicable ticketing, service or booking fee - all reflected in that single total and flagged before you pay. We will not add undisclosed fees on top of the total shown.
9. Your ticket and entry
- A ticket is a limited, revocable licence to attend the specific event, on the date and time, and subject to the conditions shown at purchase.
- Some experiences carry a minimum audience age and content or health warnings (for example, physical intensity, enclosed spaces, or sensory effects). Any minimum audience age, content rating or other eligibility requirement for an event is shown at the point of purchase, and you confirm it as part of buying.
- We may refuse entry, or require a person to leave, on reasonable grounds - including safety, conduct, or failure to meet a stated age, health or eligibility requirement, or failure to complete any required acknowledgement - acting reasonably and consistent with your rights under the Australian Consumer Law.
10. Show-specific warnings and acknowledgements
Individual experiences may require you to read and acknowledge show-specific safety, content, health or eligibility warnings, and to complete any participation acknowledgement for that experience, before or at the point of purchase and again at check-in. By completing a purchase you agree that:
- you accept the warnings and acknowledgements displayed for that experience at the time of purchase; and
- where an experience requires an acknowledgement to be completed before entry, admission is conditional on completing it, and we may refuse entry or require a person to leave if it is not completed (subject to your non-excludable rights under the Australian Consumer Law and any refund right in section 11).
The specific warnings, acknowledgements and any participation conditions for an experience are set per event and shown to you for that experience - they are not restated here.
11. If we cancel or materially change an event
If we cancel an event, or make a material change to it (for example, a significant change of date, format or location), you are entitled to a refund of the amount you paid for the affected ticket. This right applies regardless of any other term.
This reflects a right you have under the Australian Consumer Law that cannot be excluded. The only situation in which the event-specific terms govern instead is where an event is cancelled solely because of a third party or government action genuinely outside our control - and even then, your non-excludable consumer guarantees continue to apply, and those event-specific terms cannot reduce your Australian Consumer Law rights or impose a disproportionate forfeiture of the amount you paid.
12. Exchanges, rescheduling and changes you make
Whether an event lets you exchange, reschedule or change a ticket - and any deadline or fee for doing so - is set per event and shown to you at the point of purchase. These vary from event to event, so they are not fixed in these general terms.
Change of mind is not a refund right. Outside the cancellation or material-change situation in section 11, and outside any policy an event chooses to offer, tickets are not refundable for change of mind.
13. Event-specific terms - where the detail lives
Every ticketed event has its own event-specific terms, in place before it goes on sale, set per event and shown to you at the point of purchase, before you pay, and available with your booking information. Those terms may be more generous than these terms; they can never fall below them or below your non-excludable rights under the Australian Consumer Law.
14. Buying through a third party ticketing platform
Sometimes you buy a ticket to a Realscape experience through a third party ticketing platform (for example, a festival box office such as Adelaide Fringe). When you do:
- that platform is the seller for that transaction, and their terms of sale apply to your purchase - including their booking fees and their refund, exchange and cancellation terms, which may differ from these terms;
- please review the third party platform's terms at the point of purchase before you buy; and
- our experience-level information still applies (what the experience is, its age and content requirements), but the purchase, payment and refund terms are governed by the provider you bought from - and your non-excludable rights under the Australian Consumer Law continue to apply regardless of who you bought from.
15. Resale
Tickets are sold for personal use. Unauthorised commercial resale or touting is not permitted. A ticket offered for resale in breach of these terms or of the law of the place the event is held may be cancelled, and we may refuse entry on it - acting reasonably and not so as to unfairly penalise a genuine buyer. Any permitted resale must comply with that local law and with any conditions shown in the event-specific terms.
Part C - General
16. Purchases, pricing and content accuracy
- Purchases made through the Site are governed by these Terms together with any applicable Digital Content Terms and any event-specific terms shown at purchase.
- On purchases made through our own checkout, prices are shown inclusive of all mandatory charges, including GST - the total price you see is the price you pay. Where you buy through a third party ticketing provider, that provider controls its own pricing and fees (see section 14).
- We aim to keep all information on the Site accurate, but we do not warrant that descriptions, pricing or other content are always error-free. Where we have made an obvious pricing or description error, we may correct it; if you have already paid, we will offer you the corrected purchase or a full refund. This does not limit your consumer guarantees (see section 18).
17. Disclaimers and limitation of liability
To the fullest extent permitted by law, the Site is provided "as is" and "as available"; we do not warrant that it will be uninterrupted or error-free, and we are not liable for indirect, incidental, special or consequential losses arising from your use of the Site.
Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy you have under the Australian Consumer Law or any other right that cannot lawfully be excluded. To the extent any part of this clause would otherwise be void or unfair, it is read down so that it operates only as far as the law allows.
18. Your consumer rights under the Australian Consumer Law
As a consumer in Australia, you have rights under the Australian Consumer Law that cannot be excluded, restricted or modified by these Terms. Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these Terms operates to exclude, restrict or modify those guarantees or any other right you have that cannot lawfully be excluded. Where these Terms and your non-excludable rights conflict, your non-excludable rights prevail.
For a major failure of a service you may choose to cancel and obtain a refund of the unused portion, or to keep it and seek compensation for the reduced value. If you are not satisfied, you can also seek help from the ACCC or your state or territory consumer-affairs body.
19. Changes to these terms
We may update these Terms from time to time. We will change the "last updated" date below, and where a change materially affects your rights we will take reasonable steps to notify you in advance. Previous versions remain available on request. The terms that applied when you made a purchase continue to govern that purchase. Your continued use of the Site after a change takes effect means you accept the updated Terms.
20. How you agree to these terms
By accessing or using the Site, you agree to the general terms in Part A. By completing a ticket purchase, you agree to the ticketing terms in Part B, the event-specific terms shown to you, and our Privacy Policy.
21. Disputes and governing law
These Terms are governed by the laws of the State of Victoria, Australia, and you and we submit to the courts of Victoria - except that this does not deprive you of the protection of mandatory consumer laws (the Australian Consumer Law; see section 18). Event- and locale-specific terms may specify the law and forum for a particular event.
There is no mandatory arbitration clause and no class-action waiver in these Terms; disputes are resolved in court.
